1. Information on how to submit a local building community project for consideration by the Tooheys New Crew forms part of these conditions. By submitting a project for consideration by the Tooheys New Crew, entrants agree to be bound by these conditions. Submissions must comply with these conditions to be valid.
2. Projects may only be submitted by residents of NSW and QLD who are 18 years and over. Employees and their immediate families of the Promoter and agencies associated with the Tooheys New Crew campaign are ineligible to enter.
3. Entrants may submit to the Promoter a proposed local community building project in NSW or QLD which they consider would benefit from the support of the Tooheys New Crew. The submission should include the following:
   • a brief summary of the proposed project;
   • geographic location of the proposed project;
   • what cause or organisation the Tooheys New Crew would be supporting;
   • and the reason for, and expected results of the project (such as impact on the community and needs being addressed).
4. To submit a project entrants must either (a) complete the submission form at facebook.com/tooheysnew; (b) complete the submission form at tooheysnew.com.au; or (c) post a hard-copy submission form to: Tooheys New Crew promotion, PO Box Q1915, QUEEN VICTORIA BUILDING, NSW 1230. Entrants must complete all sections of the submission form including full name, town, postcode and email. Confirmation of receipt of your submission will be communicated via email. A short-list of entrants will be contacted by the Promoter, or a representative of the Promoter, at a time chosen by the Promoter to seek further information regarding a proposed project or to make arrangements to view proposed projects.
5. Public submissions for the Tooheys New Crew campaign will open at 12.00pm EDT on 01/09/11 and close at 11:59pm EST on 31/07/12. Entrants will be notified if their project was chosen before 30/08/12. The Promoter may choose none, one or more projects at its sole and absolute discretion. The Promoter makes no representation that any project submitted will be selected.
6. The Promoter's decision to select or not select a project is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected submissions or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches.
7. The Promoter will determine at its sole and absolute discretion the amount of the financial investment spent on each selected project and when the project will be conducted. The Promoter will also determine at its sole and absolute discretion what work will be undertaken on the project (which may differ from what was originally suggested in the submission form).
8. The Promoter reserves the right to request verification of age, identity, and residential address of entrants and any other information relevant to entry into or participation in this campaign. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to refuse to commence work on a winning project and retract a selected project announcement if any individual provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this campaign.
9. The conduct of the projects is subject to an agreement to be entered into with Australian Media Constructions Pty Ltd. The Promoter is not responsible or liable for any loss, damage or injury as a result of the conduct of Australian Media Constructions Pty Ltd or otherwise as a result of a winning project taking place, except for any liability which cannot be excluded by law.
10. Before a project is confirmed to go ahead, the relevant community or club will be required to sign an agreement with Australian Media Constructions Pty Ltd, and may also be required to enter into further agreements with other third parties as determined by the Promoter in its sole and absolute discretion. A project is considered finally awarded only once all contractual documentation as required by the Promoter is in place and the Promoter may withdraw its support for any selected project at its sole and absolute discretion until all contractual documentation as required by the Promoter is in place.
11. The Promoter shall not be liable for any loss, damage or injury suffered by any entrant as a result of the entrant submitting a project for consideration by the Tooheys New Crew,or as a result of a project not being completed except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter or which otherwise cannot be excluded by law.
12. Entrants consent to the Promoter using their name and any images submitted in any media for an unlimited period of time without remuneration for the purpose of promoting this campaign and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
13. Entries remain the property of the Promoter. Details from submissions will be collected and used for the purpose of conducting this campaign and for promotional purposes surrounding this campaign. By submitting entries for consideration by the Tooheys New Crew entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter's privacy policy by contacting the Promoter on 1800 308 388 during office hours.
14. The Promoter is Lion-Beer, Spirits & Wine Pty Ltd (ABN 13 008 596 370) of Level 7, 68 York Street, Sydney NSW 2000.
